What is a Settlement Agreement, and should I consult an employment  Lawyer?

A Settlement Agreement (also called a Compromise Agreement) is a contract between an employer and an employee. It will cover specific payments made, and any additional terms addressed when employment is terminated for whatever reason.

After any negotiations, the employer will agree to pay the employee a fixed sum of money (often known as reverence pay) which will cover any redundancy pay, holiday pay owed or as a fair settlement to any bonus or benefit schemes. After signing the Settlement Agreement, an employee will then forfeit any rights to further negotiations or legal proceedings.

Employers in the UK do not have a legal obligation to provide a Settlement Agreement and if you don't get offered one, firstly ask your employer or HR department for one. The next step is to consult the services of an experienced Settlement Agreement Solicitor. This will ensure you receive the best advice and ensure the best outcome. A Settlement Agreement will become legally binding after the employee has consulted with a Solicitor and both parties have signed.

Please get in touch or read through our Settlement Agreement FAQs if you have further questions. We have helped hundreds of people in Oxford and further afield and we would be happy to assist you too.
